Call of 20th State Conference of Democratic Lawyers Association, West Bengal
The 20th State Conference of Democratic Lawyers Association, West Bengal has completed in Comrade Dilip Gupta Nagar (Kolkata) at Comrade Samar Dutta Mancha (Moulali Yuba Kendra) on 10th and 11th December 2011. Four years have elapsed since the completion of last State Conference held at Barasat in the year 2007. In the mean time the scenario of the state politics has changed with the change of the Government in May 2011. The Left Front has lost in the last assembly election of the state and gradually the attack on democracy has been raged by newly elected ruling alliance led by TMC. Since the state has not witnessed such a brutal and undemocratic attack on the democratic system in last 34 years during the time of Left Front Government, it has become a newly emerged situation. The Conference has stressed on the analysis of the situation and pledged to built-up the lawyer's organised force to tackle the situation successfully. The conference expressed its concern for the growing attack on democratic rights of the people of West Bengal.
Bring out the Best time from the womb of the Worse
On 10th December the Conference was started with the hoisting of flag of organisation and by offering the floral tribute to the martyrs who have sacrificed their lives for the cause of Secularism, Justice, Democracy and Socialism, which was followed by the formal inauguration of the delegates session by Mr. D. K. Agarwal, the General Secretary of the All India Lawyers Union (AILU). In his inaugural speech Mr. Agarwal has reminded about the rights of the people vested by the Constitution and explained the necessity to implement and enforce them in order to secure ultimate goal of an egalitarian society. Among others the eminent lawyers and legislative expert Comrade Hasim Abdul Halim and Senior Advocate and ex- advocate General of the State, Comrade Nara Narayan Gooptu have spoken in the inaugural session. Comrade Halim has called for a battle to protect democracy. He has also mentioned about the curtailment of democratic rights of the people during the time of emergency and role of the organisation to protect those rights. Comrade Gupta has spoken about the history of the Organisation to re-establish democracy after the black days of seventies in West Bengal. The state secretary of West Bengal Democratic Women's Association Comrade Savitri Majumder had expressed the solidarity of her organisation towards the conference. She has expressed her concern on the attack on women's right throughout the country and called for a joint movement with DLA West Bengal in order to protect and enforce women's rights.
Comrade Ashoke Baxi, the General Secretary of the outgoing State Working Committee of Democratic Lawyers Association, West Bengal has placed the draft resolution for the discussion in the Conference. 39 delegates have discussed and contributed with their thoughts. The most significant aspect of this conference was that the most of the speakers form every district were the Junior Lawyers unlike the previous conferences.
To Combat the Legal Battle Against the Anti Democratic Attack
The draft resolution has provided the direction on the duty of the organisation at newly emerged situation of the state by referring the recent growing attack on democratic rights of the people of West Bengal the draft resolution stated that, The opportunist right wing alliance has come to state power after a long term of 34 years. All imperialist agents, all opposition parties, left and right wing opportunists and a large section of media came together and started anti Left Front campaign, before the last Lok Sabha election in 2009. It has also mentioned that after the assembly election 2011 the working class people and the general people have been subjected to the primary attack of the TMC. Since the election result was out, almost 49 Left leaders, supporters and general people have been killed all over the state. 40 thousand people have become homeless. The false cases have been registered against the Left Front workers all over the state. The conference has directed that the essential work is to increase the strength of the organisation, to make our workers and members aware of the situation and participate in the united resistance. The Conference has also pledged to provide firm and efficient service to the people who have been attacked for their participation in the democratic movement.
To Fight for Accountable Judiciary
The 20th Conference has called for a fight to build up more accountable judicial system. It has expressed its concern over the growing influence and pressure on judiciary by the executive. The Conference has urged for a fight to combat such pressure, where a section of ministers of the new Government are also involved. On contrary to the Constitutional aspiration to provide an impartial judicial system the ruling class and their representative political party TMC is imposing the pressure on the judiciary. The Conference has pledged to fight against such unconstitutional trend in order to provide justice to the people. This duty has been described as a historical duty demanded by the time.
To Fight for Speedy Justice with Assurance of Protection of Peoples Right
The draft resolution has also discussed the problem related to the day-to-day work in court. It has emphasised on the problem related to delay in justice delivery system. The organisation has also pointed out the problem related to the vacancies of the court officers and the pendency of huge number of cases in the court. The conference has also discussed the professional issues of the lawyers.
A State Council consisting of 171 members have been elected by the conference. The delegates have elected members Advisory Committee chaired by Comrade Balai Chandra Roy. The State Council has elected a Working Committee of 78 members and subsequently a secretariat of 25 members has been elected by them. Comrade Ashoke Baxi has been re elected as the General Secretary of the organisation. Comrade Nisith Adhikari has been elected as the president and Comrade Rabilal Moitra has been elected as the Working president of the organisation.
The State Conference has pledged to gear up the moments of the lawyers for their professional and political issues. Especially in the new situation when the democratic rights of the people are under attack of TMC led Government the organisation has committed to use its entire force for the protection of the democratic rights. In this manner it will perform its historical role. In nutshell the feelings of the conference was that it is the best of the times, it is the worse of the times but it is the duty of us to pull out the best from the womb of worse.
